General
These Gift Voucher Terms govern the use of ADORN Gift Vouchers. These Gift Voucher Terms constitute a binding legal agreement between Adorn Mineral Cosmetics Pty Ltd (‘ADORN,’ ‘we,’ ‘us’ or ‘our’) and the person purchasing, redeeming, or attempting to redeem an ADORN Gift Voucher (you). These Terms are to be read in conjunction with our Terms + Conditions and other terms or policies.
These Terms apply when you purchase, redeem, or attempt to redeem an ADORN Gift Voucher (collectively ‘using’ an ADORN Gift Voucher). By using an ADORN Gift Voucher, you warrant and represent to ADORN that you have read and agree to be bound by these Terms and that you will not undertake any fraudulent or misleading conduct relating to an ADORN Gift Voucher. If you are giving an ADORN Gift Voucher as a gift, it is your responsibility to ensure that the recipient is aware of these Terms.
Validity + expiry
The ADORN Gift Vouchers:
- Are valid for 3 years from the date of purchase, irrespective of when the recipient may receive it, and can be redeemed against all products except other ADORN Gift Vouchers on the website.
- All ADORN Gift Voucher amounts are in Australian dollars (AUD).
Amounts of purchase
If the ADORN Gift Voucher is used on a purchase of a lower value than the amount remaining on an ADORN Gift Voucher, the remaining amount will resume on the same ADORN Gift Voucher. This can then be used on future purchases and will be valid for the same ADORN Gift Voucher expiry period. If a purchase exceeds the value of the ADORN Gift Voucher, the remaining amount must be paid for by another payment method, such as card, Afterpay or PayPal.
Gift Voucher
If you buy an ADORN Gift Voucher;
The Gift Voucher will be emailed to the recipient once the full order has been processed and payment has been made (unless an alternate date is selected). An invoice with proof of purchase will be sent to the purchaser as confirmation;
The Gift Voucher will include a unique code that can be used online. The unique code needs to be entered at the point of reviewing items in an order (in the checkout process);
You are responsible for ensuring you have entered the correct full name and email address for the recipient. ADORN is not liable for delivery of an ADORN Gift Voucher to an incorrect or non-existent email address; and Promotion codes cannot be applied to the purchase of an ADORN Gift Voucher.
Returns and exchanges on ADORN Gift Vouchers
You cannot exchange your ADORN Gift Voucher for a different denomination of Gift Card or another tender or discount.
ADORN Gift Vouchers cannot be returned for change of mind.
Lost or stolen Gift Vouchers
ADORN is not responsible if an ADORN Gift Voucher is lost, stolen, or used without permission. ADORN Gift Vouchers should be treated like cash and will not be replaced or refunded if they are lost or used without permission.
Cancellations and alterations
ADORN Gift Vouchers cannot be cancelled once they are issued, except if used, expired, or otherwise cancelled by ADORN.
ADORN reserves the right to cancel or alter the balance of an ADORN Gift Voucher if such action is deemed necessary by ADORN, without notice to you, including but not limited to, where a Gift Voucher is defrauded, altered, issued in error, or otherwise tampered in any way. Where ADORN has cancelled or voided your ADORN Gift Voucher due to ADORN’s fault or negligence, ADORN will provide you with a refund or replacement ADORN Gift Voucher.
We reserve the right to cancel or block your ADORN Gift Voucher if you report it stolen or if we consider that you are using it in a manner that is inconsistent with these Gift Voucher Terms.
Disclaimers
ADORN Gift Vouchers are not legal tender, account/credit/debit cards, or securities, and no transaction statements will be sent to you regarding your ADORN Gift Voucher.
Limitation of liability
You agree that you are responsible for the use and protection of your ADORN Gift Voucher and that you are liable for all transactions on your ADORN Gift Voucher, except to the extent to which there has been fraud or negligence by ADORN.
You have certain rights under the Australian Consumer Law which cannot be excluded and are not affected by these Terms. To the maximum extent permitted by law, ADORN excludes all other liability arising out of or in any way connected with these Terms, including any liability for consequential or indirect losses of any kind, loss of profit, revenue, or goodwill, howsoever arising and whether caused by breach of statute, breach of contract, negligence, or other tort.
To the maximum extent permitted by law, our maximum aggregate liability to you is limited to the purchase price of your ADORN Gift Voucher.
Variation & waiver
A provision of these Gift Voucher Terms or a right created under it, may not be waived, or varied except in writing with the consent of each of the parties.
Severability
Any provision of these Gift Voucher Terms that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not invalidate the remaining provisions of these Gift Voucher Terms nor affect the validity or enforceability of that provision in any other jurisdiction.
Governing law
These Gift Voucher Terms are governed by the law of Victoria. Each party submits to the exclusive jurisdiction of courts exercising jurisdiction there in connection with matters concerning these Gift Voucher Terms.
Amendments
These Gift Voucher Terms may be amended from time to time by ADORN and the latest version will be published on the ADORN website. It is your responsibility to keep up to date with these Gift Voucher Terms.
ADORN reserves the right to amend these Gift Voucher Terms at any time for any reason by two (2) weeks’ notice to you via the ADORN website. If you do not agree with such amendments, you may contact us, and we will cancel and refund your Gift Voucher or provide an alternate resolution.
Any amendments to these Gift Voucher Terms will apply to all Gift Vouchers purchased or redeemed after the amendment date.
